DGT theory test topics › Use of the Vehicle
In Spain everyone in the car must wear a seat belt, and children of 135 cm or less must travel in an approved child seat suited to their height and weight, normally in the back. Holding a mobile phone while driving costs 6 points and 200 euros; not using a seat belt, helmet or child seat costs 4 points.
Key rules to remember
- Children: under-18s of 135 cm or less must use an approved child restraint system. They travel in the back seats, except when there are no back seats, when they are already taken by other children in child seats, or when the seats cannot be fitted there.
- Seat belts: since 1 October 2026 the old exemptions for taxi drivers, goods vehicle drivers and driving instructors no longer exist.
- Mobile phone: holding the phone while driving means 200 euros and 6 points; using it without a hands-free system or wearing headphones (even one earpiece) is also an offence.
- Seat belt, helmet or child seat not used: 200 euros and 4 points. The driver is responsible when a child travels without a child seat.
- Motorcycles and cycling (since 1 October 2026): gloves are compulsory on interurban roads and closed footwear on all roads; cyclists must wear a helmet on interurban roads.
Exam tip: Questions about children and seat belts are easy points if you remember the key number: 135 cm.
