1. Definitions

"English Driving School" / "EDS": Juan Jesús Gil Lamela, NIF: 78967382X, operating the website www.englishdrivingschool.com
"User": Any person who accesses or uses the EDS platform
"Service": Online theory test preparation materials, including practice questions, theory book, and audiobooks
"Subscription": Paid access to the Service for a defined period
"Upgrade": Changing from a lower-tier plan to a higher-tier plan during an active subscription
"Renewal": Purchasing a new subscription period after the current one has expired or is about to expire

2. Service Description

English Driving School provides online educational content to help foreign residents in Spain prepare for the DGT (Dirección General de Tráfico) theory driving test in English. The Service includes:

• Over 3,000 official DGT practice questions with explanations
• Practice by topic (10 subject areas)
• Online theory book (updated for 2026)
• Audiobooks (available on higher-tier plans)
• Progress tracking and weak-area identification
• Reference documents

3. Subscription Plans and Pricing

We offer two ways to pay: one-off plans of a fixed duration, and a monthly subscription that renews automatically until you cancel it. Current prices are displayed on the registration page and may be subject to promotional discounts. All prices include applicable taxes.

3.1 Plan Features

• Online Access (Plan 1) — €29.95: Access to all 3,000+ questions, practice by topic, and progress tracking. Valid for 90 days.
• Online Access + Book (Plan 2) — €39.95: Everything in Plan 1, plus the online theory book. Valid for 90 days.
• Full Course (Plan 3) — €49.95: Everything in Plan 2, plus audiobooks. Valid for 180 days.

The same access is also available as a monthly subscription:

• Online Access — €14.99 per month: the same content as Plan 1, billed every month until you cancel.
• Online Access + Book — €19.99 per month: the same content as Plan 2, billed every month until you cancel.

The price you pay when you subscribe stays the same for as long as your subscription remains active, even if we change our prices later. Full Course is available only as a one-off plan.

3.2 Duration

One-off plans are time-limited: access expires on the date shown in your account, and once it expires, access to paid features is suspended until you buy a new period. Nothing is charged automatically.

The monthly subscription has no end date. It is charged every month and your access is extended each time, until you cancel it. Your account always shows the date your current access runs to.

In both cases your study progress and statistics are kept, even while your access is suspended.

4. Upgrade

If you have an active subscription (Plan 1 or Plan 2) and wish to access features included in a higher-tier plan, you may purchase an Upgrade at any time from your account area.

If you are on a one-off plan, an Upgrade grants immediate access to the additional features of the new plan. The remaining days of your current subscription are preserved. The Upgrade cost reflects the difference in value between your current plan and the new plan, as displayed at the time of purchase.

If you are on the monthly subscription, upgrading changes your subscription from €14.99 to €19.99 per month. You are charged only the proportional part corresponding to the days left in the current month, and from the following month you are billed the new amount. Full Course is not available as an upgrade from a monthly subscription, because it is a fixed-duration product.

5. Renewal

When your subscription expires, you may renew it from your account area. Renewal purchases a new subscription period starting from the date of payment. Your accumulated study progress and statistics are retained across renewals.

You may choose any available plan upon renewal, regardless of your previous plan.

5.1 Monthly Subscription (auto-renewing)

As an alternative to the one-off plans above, we offer a monthly subscription billed in advance at €14.99 (Online Access) or €19.99 (Online Access + Book). The subscription renews automatically every month until you cancel it, and each renewal is charged to the payment method you provided.

You can cancel at any time from your dashboard, in one click. Cancellation takes effect at the end of the period you have already paid for: you keep full access until that date, and no further charges are made. We do not require you to contact us or give a reason.

If a payment fails, we keep your access active for a short grace period while the payment is retried. If it cannot be collected, the subscription ends and access lapses on its normal expiry date. Monthly subscriptions are processed by Stripe Payments Europe, Ltd., and you receive an emailed receipt for every charge.

The monthly subscription and the one-off plans are independent products. Buying one does not cancel the other: if you hold a subscription and also purchase a one-off plan, remember to cancel the subscription so you are not charged twice. Any access time you have already paid for is never lost.

6. Payment Terms

6.1 Payment Methods

We accept the following payment methods:

• Bank card (Visa, MasterCard, Maestro, American Express): processed via Redsys, the secure payment gateway used by Spanish banks.
• PayPal: processed by PayPal (Europe) S.à r.l. et Cie, S.C.A.
• Stripe: used for monthly subscriptions, processed by Stripe Payments Europe, Ltd. Your card details are stored by Stripe, never by us, so that renewals can be collected automatically.

6.2 Payment Security

All card payments are processed directly on Redsys's secure payment page (PCI-DSS compliant). EDS does not see, handle, or store your card details at any point. PayPal payments are handled entirely within the PayPal environment.

6.3 Billing

All subscriptions, upgrades, and renewals are one-time payments — there are no recurring charges or automatic renewals. You will receive an email confirmation upon successful payment. Access is granted or upgraded immediately after payment verification.

7. Refund Policy

In accordance with Article 103(a) of Royal Legislative Decree 1/2007 (Spanish Consumer Law), the right of withdrawal does not apply to digital content services that have been fully delivered with the user's prior consent. However, we offer refunds under the following conditions:

• 7-day cooling-off period: You may request a full refund within 7 days of purchase, provided you have not accessed more than 25% of the available content.
• Technical issues: If a verified technical problem prevents access to the service for more than 48 hours and our support team is unable to resolve it.
• Monthly subscription: because you can cancel at any time before the next charge, renewals are generally non-refundable. If you were charged for a month you did not intend to renew and you have not used the service in that period, contact us and we will refund it. Refunding a charge also ends the access it paid for.

Refund requests must be sent to info@englishdrivingschool.com with your order details. Approved refunds are processed within 14 days to the original payment method. Upgrades and renewals are subject to the same refund conditions.

8. User Obligations

By using our Service, you agree to:

• Provide accurate and complete registration information (including your DNI/NIE)
• Keep your login credentials confidential and not share them with others
• Use the Service only for personal, non-commercial study purposes
• Not copy, distribute, publish, or resell any content from the platform
• Not use automated tools (bots, scrapers) to access or extract content
• Not attempt to circumvent access controls or subscription restrictions
• Be at least 17 years old, or have parental/guardian consent if under 18

9. Account Suspension and Termination

We reserve the right to suspend or permanently terminate your account, without refund, if you:

• Violate any of these Terms and Conditions
• Share your account credentials with other people
• Attempt to copy or systematically extract our content
• Engage in fraudulent payment activity

10. Intellectual Property

All content on the EDS platform — including practice questions, explanations, theory book content, audiobooks, software, design, graphics, and logos — is the property of English Driving School or licensed to us, and is protected by Spanish and international copyright law (Real Decreto Legislativo 1/1996, Ley de Propiedad Intelectual). You may not reproduce, distribute, or create derivative works without our express written permission.

11. Limitation of Liability

• EDS is not responsible for your success or failure in the official DGT exam.
• EDS does not guarantee that using our Service will result in passing the official test.
• EDS is not liable for any indirect, incidental, or consequential damages arising from use of the Service.
• Our total liability shall not exceed the amount you paid for your most recent subscription, upgrade, or renewal.

While we strive to keep content up to date, traffic regulations change. Always verify current rules with official DGT sources (www.dgt.es).

12. Service Availability

We aim for continuous availability but do not guarantee uninterrupted access. We reserve the right to carry out maintenance, which may temporarily suspend access. We will endeavour to notify users in advance of planned maintenance.

We shall not be liable for interruptions caused by events beyond our reasonable control (force majeure), including power failures, internet outages, natural disasters, or government actions.

13. Modifications to Service and Terms

• We may update these Terms and Conditions at any time. The updated version will be published on this page with a revised date.
• We may change pricing for new subscriptions, upgrades, and renewals. Prices at the time of purchase are the prices that apply.
• We may modify or discontinue features of the Service with reasonable notice.

Continued use of the Service after changes to these Terms constitutes your acceptance of the new terms.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Spain. Any disputes shall be subject to the jurisdiction of the courts of Málaga, Spain, without prejudice to your rights as a consumer under applicable EU law.

As a consumer in the EU, you may also access the Online Dispute Resolution platform: https://ec.europa.eu/odr

15. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. All remaining provisions shall remain in full force and effect.

16. Mobile Application and In-App Purchases

These Terms apply equally to use of our mobile app (iOS and Android).

Subscriptions purchased inside the app

• Payment is charged to your Apple ID or Google account at confirmation of purchase.
• Subscriptions renew automatically for the selected period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price then in effect.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current paid period.
• Refunds, where applicable, are handled directly by Apple or Google according to their respective policies. We do not process refunds for in-app purchases.

Auto-renewable subscriptions available in the app

• Monthly Premium — 14.99 € / 1 month (auto-renewable monthly).
• 3-Month Premium — 39.99 € / 3 months (auto-renewable every 3 months).

Both plans grant full access to the question bank, theory book, audiobooks and tutor support while active. Prices shown include applicable taxes and may vary by territory as set by Apple or Google.

Account deletion and subscription

Deleting your account on our servers does NOT cancel an active Apple or Google subscription. You must cancel it directly from your App Store or Google Play settings to stop further renewals.
